Kratom Law Changes 2026: What’s New (November Update)

Quick answer: Natural kratom leaf is still federally legal as of November 2, 2026. The DEA scheduled three synthetic kratom-related compounds on August 26, 2026, and an amended order on concentrated 7-OH products could start as early as November 13. At the state level, Massachusetts banned kratom by emergency order, North Dakota paused sales pending new rules, and Kentucky’s commercial ban starts July 1, 2027.

What changed at the federal level?

Two federal actions matter in 2026, and neither one schedules the natural kratom leaf:

  • August 26, 2026: mitragynine pseudoindoxyl, MGM-15 and MGM-16 became Schedule I under a two-year temporary order (Vicente LLP).
  • 7-OH (amended): in October the DEA withdrew its July notice and replaced it with a new threshold. Products with more than 1 mg of 7-OH per gram (or per mL for liquids), or more than 1 part 7-OH per 100 parts mitragynine, are the target. The earliest start date is November 13, 2026 (Federal Register public inspection).
Federal item Status Natural leaf affected?
MGPI, MGM-15, MGM-16 Schedule I since Aug 26, 2026 No
Concentrated 7-OH (above threshold) Amended order, earliest Nov 13, 2026 Not the target
Kratom leaf (Mitragyna speciosa) Not federally controlled —

What does the 7-OH threshold mean for kratom products?

The federal line separates natural leaf products from products that have been concentrated or enhanced with 7-OH. Natural kratom leaf contains only a small share of 7-OH among its alkaloids. The amended threshold is set above that natural level, so the order aims at extracts, tablets and shots built around concentrated 7-OH. Read what the MIT percentage means to see how alkaloids appear on a lab report.

Are local kratom bans increasing?

Yes. Even where a state allows kratom, cities and counties can ban sales. New York saw several county bans in 2026, and states such as Florida, Washington, Illinois, Mississippi and Colorado already have local bans. Always check your city and county, not just your state.

FAQ

Is kratom federally legal in November 2026?

Yes. Natural kratom leaf is not a federally controlled substance. Three synthetic kratom-related compounds became Schedule I on August 26, 2026, and the DEA is moving to schedule concentrated 7-OH products above a set threshold.

When does the federal 7-OH order start?

The amended DEA order could start as early as November 13, 2026. A temporary scheduling order starts on the day it is published, so the exact date depends on the DEA.

Does the 7-OH order cover natural kratom powder?

The amended order targets products that are intentionally enhanced or concentrated: more than 1 mg of 7-OH per gram or per mL, or more than 1 part 7-OH per 100 parts mitragynine. Natural leaf is not the target.

Which states changed their kratom laws in 2026?

Major 2026 changes include a Massachusetts emergency Schedule I order, North Dakota’s HB 1628, a Kentucky commercial ban starting July 1, 2027, Maryland’s new regulation law, and new county bans in New York.
